JBL SNOW PARTY PROMOTION

TERMS AND CONDITIONS

Promoter:

  1. The Promotion is offered by Harman International Industries Pty Ltd – Level 21, 55 Collins Street Melbourne VIC 3000 Australia (‘Promoter’). The Promotion is offered exclusively to customers of Spark New Zealand Ltd (‘Retailer’).

Eligibility Criteria:

  1. This promotion is open to New Zealand residents only and entrants must be aged at least 18 years or over to participate.  You must not be an employee (or immediate family member of an employee) of the Promoter, the Retailer, or the advertising agency.  An immediate family member includes a spouse, grandparent, parent, child, grandchild (whether by marriage, past marriage, adoption, co-habitation or other family extension).  If you do not satisfy these requirements, your entry will not be eligible for the Prizes.

Entry Mechanism and Criteria:

  1. To submit an Entry for the Prize Draw, you must purchase a JBL audio device in a single transaction from the Retailer (Spark), either in-store or on the Retailer's website – spark.co.nz (‘Qualifying Purchase’) during the Promotion Period (defined below).   Entries into this competition are tiered and based on purchase price. $1-$199.99 - One entry | $200 - $399.99 - Three entries | $400+ - Five entries.
     
  2. One Entry will be selected by random electronic draw from all valid Entries received during the Promotion Period (‘Prize Draw’. The eligible Entry drawn will win the Prize provided that (a) the Entry comply with these Terms, (b) the Entrant can be contacted within a reasonable time and (c) the Entrant collect their Prize within a reasonable time (‘Winner’).  Any Entry drawn that do not comply with these requirements will not be awarded the Prize and may require further Entries to be drawn.
     
  3. Neither the Promoter, the Retailer nor any other entity associated with this competition will be responsible for any late, lost, misdirected or incorrectly submitted Entries, including but not limited to Entries not received due to technical problems or human error.

  1. The Promoter reserves the right to disallow entries in its absolute discretion and without giving reasons.

  1. The Promoter reserves the right, at any time, to verify the validity of Entries and determine the eligibility of Entries (including your identity) and to disqualify any entry or refuse to award a prize where false or misleading details have been provided, or where you have behaved in a fraudulent or dishonest manner, or otherwise than in accordance with these terms and / or the spirit of the Promotion.

  1. Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter via email at support.apac@harman.com.

  1. The Retailer is not responsible for the: (a) entry form, (b) Prize Draws and (c) provision of and any changes to the Prize.  Any queries, claims and disputes in relation to the Promotion shall be a matter between you and the Promoter. 
     

Promotion and draw dates:

  1. The Promotion commences at 12:00am on 14/11/2023 and finishes at 11:59pm on 21/01/2024 (‘Promotion Period’).  Entries to the Prize Draw received outside the Promotion Period will not be eligible for Prizes.  Entries are deemed to be made at the time they are received by the Promoter.
     
  2. Winner of the Prize Draw will be notified by the Promoter within 5 business days of the Prize Draw by telephone or email on the contact details provided in their Entries.  Only the person that submitted an Entry is able to claim the Prize.  All decisions made by the Promoter are final and no correspondence will be entered into.
     

Prize Details:

Each Prize includes:

    1. Return economy class flights for winner and 1 (one) winner’s guest from the winner’s nearest New Zealand commercial airport to Geneva Switzerland.

    1. All airline taxes.
       
    2. A ticket for winner and guest to JBL Snow Party 2024  - April 10 to April 14 2024 in Val Thorens, France.

    1. Return bus transfers from Geneva, Switzerland airport to Club Med, Val Thorens, France.

    1. 4 nights accommodation in a standard room at Club Med Val Thorens, France.  

    1. Breakfast, lunch and dinner at Club Med included.

    1. A travel insurance policy for winner and guest for up to 5 days (based on being under 65 years with no pre-existing medical conditions). Travel insurance will cover ski/snowboard activities.

    1. Ski or Snowboard hire for winner and guest for entire stay.

    1. 4 day Val Thorens lift pass for winner and guest.

Each prize excludes:
 

    1. Any meals or beverages purchased outside of Club Med resort or JBL Snow Party official events.
       
    2. Any sight seeing or activity not sanctioned or offered by Harman International Industries.
       
    1. Any souvenirs, clothing, accessories, toiletries or groceries purchased by the winner at shops within the Val Thorens precinct.
       
    1. Transfers to/from winners home to nearest Commercial Airport in New Zealand.
       
    2. Mobile or international roaming data usage.
       
    3. Ski or winter appropriate clothing. Ski/Snowboard hire is included in prize. All other clothing is the responsibility of the winner.
       
    4. International phone or power adaptors.
       
    5. Passport renewal or any visas required for travel to Switzerland or France.

  1. This Prize is valid only for travel between 9 April 2024 and 15 April 2024 (‘Designated Travel Period’). All bookings and inclusions regarding the Prizes must be made via a travel agent advised by the Promoter. Redeeming Prize is conditional to accepting the terms and conditions provided the travel agent and normal travel practices. All travel is on regular scheduled services, subject to availability and may depend on specific booking classes with airlines or specific room categories with accommodation partners. All airline and accommodation options are at the Promoter’s discretion.  Prizes are not transferrable, negotiable, refundable or redeemable for cash.

  1. Prior to departure, Winners must hold valid passports with a minimum of 6 months’ validity. Winners are responsible for all costs and expenses not expressly described in clause 8, including but not limited to any amendment fees issued by airlines or suppliers after the booking issued, visas, valid passports, additional spending money, meals outside of Club Med Val Thorens, other ancillary costs, and insurance excesses.  Prizes exclude these costs and expenses.

  1. Winners must accept Prize in their entirety.  If a Winner cannot accept the Prize or take part in the Prize for any reason, their Prize will be void and no compensation will be payable to them.  Winners may purchase additions, upgrades or extensions to the Prize at their own cost after the Designated Travel Period, however changes to the trip itinerary will not be accepted.

  1. Winners accept and use Prize entirely at their own risk.  At the time of accepting Prize, Winners must sign a waiver and indemnity form.

  1. If the Prize or any part of the Prize become unavailable for any reason, the Promoter may in its sole discretion provide an alternative prize.

  1. The Promoter may vary, amend, suspend or cancel any aspect of the Promotion (including the Prizes) at any time in its sole discretion and for any reason.

Promotional Usage:

  1. You agree to the use of your name, photograph, and likeness for promotional/advertising purposes (including on websites, Facebook pages, Instagram pages, Youtube, Tik Tok and other online or physical material published by the Promoter or the Retailer).  You agree to make yourself reasonably available for this purpose.  You waive any claims to copyright, royalties, rights or remuneration.
     
  2. The Promoter (and its agents) collects and holds personal information you provide to us in connection with the promotion for business and promotional purposes.  If you do not provide personal information required for an Entry, that may make you ineligible for the Prize.  We will hold all personal information in accordance with the Privacy Act 2020.  You have the right to access and correct any such personal information.  If you wish to do so, please send an email to support.apac@harman.com.  We may disclose your personal information to third parties (including the Retailer) including for our business purposes, marketing purposes, and for the purpose of providing the Prize to you (if you are a Winner). 

General Behaviour:
 

  1. You agree to comply with all reasonable instructions given by the Promoter and other agencies associated with the Promotion.  You agree not to do anything that may bring the Promoter or Retailer into disrepute.

  1. All Winners and guests must abide by the terms, conditions, policies of the selected hotel, selected airline, and any other third-party service provided as part of the Prize. Promoter, Administrator, airline, hotel and any of the third-party vendors who provide the services as part of the Prize reserve the right to remove or to deny entry to any event or form of transportation to the Competition, Winner and/or his/her guest(s) who engage(s) in a disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the hotel, flight, or transportation or any event that Promoter provides Winner/guest access.

Liability:

  1. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

  1. Except for any liability that cannot be excluded by law, the Promoter (including its officers, directors, shareholders, employees, advisors, assignees, agents, licensees, representatives, advertising and promotional agencies), excludes all liability (including negligence) in connection with this Promotion.  That includes liability for any personal injury or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where attributable to any of the following: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter's control); (b) any theft, unauthorized access or third party interference; (c) any entry or prize claims that are late, lost, altered, damaged or misdirected ; (d) any variation in the prize; (e) any tax liability incurred by you; or (f) use of a Prize.

  1. Participation in JBL Snow Party (the “Event”) may involve certain risks, including without limitation, risks inherent in large group events and travel, the risk illness, delays, and bodily harm. Except where prohibited by law. Entrant agrees on behalf of themselves and their heirs and assigns, to release, indemnify and hold harmless Harman International Industries, Pty Ltd (Promoter) and its parent, affiliates, officers, directors, shareholders, agents, employees, and successors (the “Harman Parties”) from and against any losses, damages, rights, claim or cause of action of any kind arising, in whole or in part, directly or indirectly, out of participation in the Event, including without limitation personal injury, death, and/or property damage, as well as claims based on publicity rights, defamation, and/or invasion of privacy, whether known or unknown. Except where prohibited, participation in the Event constitutes entrants consent to the Harman Parties and their designees to use and modify (except with respect to opinions) entrants name, likeness, photograph, voice, and opinions for advertising and promotional purposes, in any manner, in any and all media, now or hereafter devised, worldwide in perpetuity, without further payment or consideration, notification or permission.
